Partner Relationship Ended Due to Family Voilence

If the relationship ceased and the applicant claims that family violence occurred while in a relationship, you can still be eligible for a grant of the partner visa. In many cases, the applicants are not required to wait out two years before being granted the partner visa.  However, if the applicant has formed a new relationship then they cannot claim Family Violence. The applicant should continue to be the partner of the sponsoring partner even after the relationship ended to be eligible to claim for Family Violence provision.

 

For prospective marriage applicants, you are only eligible to claim family violence if the violence occurred after entering Australia. Whether or not, the marriage took place. 

 

There are prescribed circumstances to be able to claim Family Violence provision and strict guidelines of evidence are prescribed.
